This makes me think it is the kernel.

No, then it's syslogd :-) If you were allowed to format with 1.15.2 but not with 1.17 with the same syslogd, then it would have something to do with the kernel. Apparently syslogd has an open file or directory on the floppy, this will (correctly) prevent Dlock() from locking the floppy and the formatting utility does not proceed with the formatting. If you used a utility that didn't care about locking the floppy first, you would be able to format.
