[Freemint-list] partition check

OK guys,

I've found the culprit: https://github.com/freemint/freemint/issues/40 ...
that's the good news. The bad news is that I have no clue: a) what fixes
this particular commit b) what will happen if I remove it c) how to keep it
and properly fix it

Alan, any thoughts?
