Maybe you don't understand what a open relay is. A open relay is an SMTP
server that can be used from *every* IP number. So everybody in the world
that have an internet connection can use these SMTP server (in
conjunction with other such servers) to safely send out SPAM.

If this ISP just limit SMTP connections to their dialin connections (and
the other points that are required to transport mail) it's no longer an
open relay. If someone send out SPAM then the ISP can trace it back to the
telephone number.
